BIPA Law Suit Against FaceTec has been Formally Dismissed

Plaintiff's counsel finds that FaceTec not subject to BIPA because software is fully managed by customers
SUMMERLIN, Nev., May 16, 2023 /PRNewswire-PRWeb/ -- A Biometric Information Privacy Act (BIPA) lawsuit filed against FaceTec, Inc. has been formally dismissed without the need for a hearing in a rare change of direction by one of the largest and most prominent plaintiff class-action firms in America.
BIPA's goal is to provide individuals with more control over their own biometric data and requires organizations to collect it only after proper disclosures and assurances are made and agreed to by the user. These terms include the specific purpose it will be collected and the duration that is stored and used. It also requires a person's written consent. Biometric information includes retina or iris scans, fingerprints, voiceprints, hand scans, facial geometry, DNA, and other unique biological information.
The initial complaint made claims that FaceTec had violated BIPA by not obtaining informed, written consent and related data storage and use. However, FaceTec's privacy-by-design architecture provides software that is installed and managed by its customer servers behind their own firewalls. The architecture does not require any personally identifiable information (PII) or biometric data from end-users be sent to FaceTec, and therefore FaceTec is not responsible for its software's commercial implementations under BIPA.
FaceTec's corporate immunity to BIPA risk is in stark contrast to other Identity-as-a-Service providers that require customers' user data be sent to their third-party servers, some of which are outside the United States, and expose KYC providers and relying parties to legal actions under BIPA.
